1. About Department :-
The Labour and E.S.I Department was originally known as Labour, Employment and Housing Department. During the year 1980, the Housing wing was separated from this Department and consequent upon restructuring of Departments vide G.A Department Notification No.24622 Dt.19.12.2011 read with their Corrigendum No. 3175/Gen dt. 10.02.2012, the Employment wing has been separated from this Department. This Department has been renamed as Labour & Employees' State Insurance Department vide Office Order No.1574/LESI Dt.27.02.2012.
It is the Nodal Department for formulating Plans, Policies and programmes for development of Labourers including child labourers (engaged under both organized and unorganized sectors) for security measures in Factories and Boilers and the social security of Industrial workers.

Details of Programme and scheme


The Building and other Construction workers (Regulation of Employment and condition of Service) Act, 1996 (Central Act) and Rules 2002.
The Building and Other Construction Workers’ (RE&CS) Act has been enacted to regulate of employment and condition of service of Building and Other Construction Workers and to provide for their safety, health and welfare measures and for other matters connected there with or incidental there to. The Board extends the following Benefits to registered Building & Other Construction Workers
Assistance in case of accident, Death Benefit, Assistance for funeral expenses, Medical Assistance under RSBY & BKKY, Marriage Assistance, Maternity Benefit, Educational Assistance, Assistance of purchase of working tools, Assistance for purchase of bi-cycle, Assistance for purchase of Safety Equipment’s, Housing Assistant under NirmanShramik Pakka Ghar Yojana, Financial Assistance for skill upgradation, Recognition for prior learning and skill development of Construction worker etc.

Office of the Divisional Labour Commissioner, Bhadrak situated at Naripur, Near SP office, Bhadrak,756100. The main function of this to deal with Industrial Dispute such as Complaint handling, enforcement of various labour laws & subsequently to deal with two welfare Board as Odisha Building & Other Construction Welfare Board & Odisha Unorganized Worker’s Welfare Board.
1.    Enforcement Section: Maintaining industrial peace and harmony including settlement of industrial dispute, implementation of settlements as well as awards passed by industrial tribunals and labour courts matters relating to strike, lockout, layoff, retrenchment, closure and prosecution under Industrial Disputes Act, 1947.
2.    Filing of claim cases and prosecutions under Minimum Wages Act and Payment of Wages Act.
3.    Registration, Licensing and Amendment under Contract labour (R &A ) Act, Interstate Migrant Workers (RE& CS) Act, Odisha Shops and Commercial Establishment Act, Motor Transport Workers Act, Building & Other Construction Work Act through Pareshram Portal.
4.    Registration of Trade Unions under Trade Unions Act and verification of membership of Trade Unions for recognition through secret ballot as per the verification of membership and recognition of Trade Union Rules 1994.
5.    Ensuring payment of notified minimum wages to workers particularly engaged in the unorganized sector under Minimum Wages Act.
6.    Ensuring social security benefits to the workers both in organized and unorganized sectors under (1) Maternity Benefits Act. (2) Payment Of gratuity Act (3) Workmen’s Compensation Act to both male and female workers.
7.    Providing protection to labour with special emphasis to eliminate and prevention of child labour under child and Adolescent Labour (Prohibition and Regulation) Act.
8.    Ensuring payment of equal remuneration to female workers both in organized and unorganized sector at par with workers doing same and similar work under Equal Remuneration Act.
9.    Preventing illegal and unauthorized drafting and exploitation of migrant labour through unscrupulous middlemen to other states under Inter State Migrant Workmen (RE & CS) Act.
10.    Prohibition and regulation of Contract Labour system in different industries in the state under contract labour ( Regulation and Abolition ) Act.
11.    The employer of an establishment has to display the name of the establishment in Odia language prominently on a signboard in front of the establishment in addition to other languages if any.
12.    Preventive measures to be taken for labourers/Workmen from possible heat wave situation. Re-scheduling working hours by complete restriction on works between 11 A.M to 3 P.M. w.e.f 1st April,2025 till 15th June,2025
13.    The Government of Odisha through resolution No 193734000120153844/I dated 10.06.2015, has constituted a Central Inspection Co-ordination Group as part of “Ease of Doing Business”  (CICG) framework for improving the inspection framework with an objective to ensure clarity on inspections, frequency of inspections, and reducing duplications. This Inspection Framework aims to achieve the objective of simplifying business regulations and bring in transparency and accountability in inspections and ensure synchronized inspections of Factories & Boilers, Labour Directorate and Odisha State Pollution Control Board (OPCB) based on risk based assessment.
14.    Extend assistance of Rs. 50,000 only to the bereaved family from District ISMW Rescue & Rehabilitation Fund under the State Coordination Cell for Migrant Workers in bringing back the dead body only after the family member of the deceased will furnish the actual expenditure statement/bill .

Grant of Maternity benefit
The maternity benefit @ Rs.10,000/- (Rupees ten thousand) only per child shall be given to the female beneficiaries subject to a maximum of two children who are registered beneficiaries for a period of one year over and above the other benefits .
Grant of Marriage assistance for marriage of Self / Dependent girl child
Applicant can apply for their daughters marriage benefit or if the applicant is a women then they can apply for their own marriage. Capture the groom and bride date of birth. The Groom should be above 18 years. At the time of registration, if the women application have mentioned as married, then she is not eligible for applying marriage benefit for herself. The board shall extend an amount of Rs. 50,000/- (Rupees fifty thousand) only towards marriage assistance to the unmarried beneficiary on her marriage or marriage of two unmarried girl children who are of above 18 years of age subject to a minimum of one year as registered beneficiary. In case, both the spouses are registered beneficiaries, either of them will be eligible to get the benefit of marriage assistance. In case of self-marriage, the benefit can be availed by any beneficiary only once during her lifetime.
Grant of Funeral expenses
The board shall extend an amount of Rs. 5,000 (Rupees Five thousand) as funeral assistance to the nominee / legal heir of the deceased beneficiary, in case of death of a registered beneficiary.
Death benefit
Death Benefits can be applied in the event of death of a registered applicant Death benefit is given to the nominee. In case there are multiple nominees then the benefit is paid to all the nominees. Payment of death benefit shall be made available within a period of sixty days from the date of submission of death application. In case of more than one legal heir, an affidavit shall be obtained from all legal heirs regarding who will receive the assistance on their behalf. In case of accidental death on the construction site, assistance will be extended to the nominee or legal heir as the case may be, of the deceased beneficiary irrespective of his place of death. In case, the nominee is a minor, the amount of death benefit maybe sanctioned subject to the condition that the amount transferred shall not be withdrawn unless the nominee attains the age of major or in case of an urgent need or demand, the same may be withdrawn with due approval of the Member Secretary of the Board. An Amount of Rs.3,00,000/- is extended towards the death Benefit under the scheme w.e.f 24.10.2024.
Forms and Procedure to apply
Every construction worker has to apply in prescribed form with registration fee amounting to Rs.20/- by enclosing

3.    Photo copy Bank Pass Book
4.    4 passport size photo
5.    The application form needs to be certified by the trade Union,
6.    Register employee or Inspector (Employment certificate).
Financial assistance for the Education of children of the beneficiary
Beneficiaries can apply for financial assistance for education of their children if they have been registered for a period of one year or more. The financial assistance for education to the beneficiary shall be entitled up to two children. In case both the spouses are registered beneficiaries, either of them will be eligible to get the benefit of educational assistance.

UNORGANISED WORKERS WELFARE BOARD
•    As per 2011 Census, the total working population of Odisha is 1.75 crore, out of which about 92% is unorganised workers. 
•    This Act mandates for registration of unorganised workers, constitution of State Unorganised Workers’ Social Security Boards and extension of social security schemes to registered workers and their families.
•    As per Sec. 2(l) of the said Act, “Unorganized sector” means an enterprise owned by individuals or self-employed workers and engaged in production or sale of goods or providing service of any kind and where the enterprise employs workers, number of workers is less than ten.
•    Sec. 2(m) defines “Unorganised worker” as a home-based worker, a self-employed worker or a wage worker in unorganised sector and Includes a worker in organised sector who is not covered by 
1.    The Employees Compensation Act, 1923;
2.    The Employees’ State Insurance Act;
3.    The EPF and Miscellaneous Provisions Act, 1952;
4.    The Maternity Benefit Act, 1961 and 
5.    The Payment of Gratuity Act, 1972. 
•    Home-based worker means a person engaged in production of goods or services for an employer in own home or other premises of choice other than workplace of employer, irrespective of provision of equipment, materials or other inputs by the employer. 
•    Self-employed worker means any person who is not employed by an employer, but engaged in any occupation in unorganized sector, subject to a monthly earning of an amount as notified by Central or State Government or holds cultivable land subject to such ceiling as notified by State Government 
•    Wage worker means a person employed in unorganized sector, directly by an employer or through any contractor, irrespective of place of work, whether exclusively for one employer or for one or more employers, whether as a home-based worker, or as a temporary or casual worker, or as a migrant worker, or workers employed by households including domestic workers, with a monthly wage of an amount as notified by the Central/ State Government. 
•    The Odisha Unorganised Workers Social Security Rules, 2010 has been formulated to carry out the provisions of the aforesaid Act in the State of Odisha. It was last amended on dated. 06.08.2019. 
•    Odisha Unorganized Workers’ Social Security Board has been constituted on dated. 22.12.2011 under the chairmanship of Hon’ble Minister, Labour & ESI, Odisha to monitor the activities of registration of eligible unorganized workers of Odisha and extension of social security benefit to them and their family members. It is being reconstituted at regular intervals.
•    Every unorganized worker who has completed eighteen years of age, but has not completed sixty years of age and who has been engaged in any unorganized sector shall be eligible for registration of beneficiary under Act.
